1. Booking Confirmation

When you submit a booking request through our website or WhatsApp, you are making a reservation inquiry. Your booking is confirmed when we respond confirming availability and agree on the date and time. Until confirmed, no contract exists between you and Red Sea Magic Boats.

2. Payment Terms

No deposit is required to secure your booking. Payment is made on the day of your trip, before departure. We accept cash (EUR, USD, EGP) and bank transfer. Full payment must be received before boarding.

3. Pricing

All prices displayed on redseamagicboats.com are in Euros (€) unless stated otherwise. Prices are per boat, not per person, unless explicitly noted. Prices include VAT and all applicable taxes. Island entry fees (€5–€10 per person) are not included in the base tour price and are payable on arrival at the island.

4. Cancellation Policy

By the guest: Cancellations made at least 24 hours before the scheduled departure time receive a full refund. Cancellations made less than 24 hours before departure may incur a 50% cancellation fee. No-shows without any prior notice are charged in full.

By the operator: Red Sea Magic Boats reserves the right to cancel or reschedule any tour due to unsafe weather conditions, sea state, mechanical issues, or circumstances beyond our control. In such cases, you will receive a full refund or the option to reschedule at no additional cost.

5. Refund Policy

Full refunds are issued for cancellations made by the operator. For guest-initiated cancellations with more than 24 hours' notice, a full refund is issued within 7 business days. Cancellations within 24 hours are subject to the 50% fee noted above.

6. Guest Responsibilities

By booking a tour, you agree to:

• Follow all safety instructions provided by the captain and crew
• Wear a life jacket when instructed
• Use only reef-safe sunscreen — regular sunscreen damages coral and is prohibited
• Not touch, step on, or remove coral, marine life, or sand from protected areas
• Not bring glass bottles to the islands (plastic and metal only)
• Inform us of any medical conditions, allergies, or mobility issues before the trip
• Supervise children at all times during the tour

7. Age Requirements

Children under 4 years old are not recommended on speedboat tours due to safety considerations. Children under 18 must be accompanied by a parent or legal guardian. There is no upper age limit, but guests with limited mobility should inform us in advance so we can assess suitability.

8. Health & Safety

Snorkeling and swimming carry inherent risks. By booking, you acknowledge that:

• You participate in water activities at your own risk
• You are responsible for assessing your own fitness and health for the activities involved
• Pregnant women, individuals with heart conditions, back problems, or other serious medical conditions should consult their doctor before participating
• Life jackets are available and recommended for all guests, regardless of swimming ability

9. Liability

Red Sea Magic Boats and its staff shall not be held liable for:

• Personal injury, loss of life, or damage to personal property during the tour
• Loss or damage to personal belongings (phones, cameras, jewelry, etc.) brought on board
• Delays or cancellations caused by weather, sea conditions, government restrictions, or force majeure
• Actions of third-party service providers (hotel transfers, island facilities, etc.)

10. Force Majeure

Red Sea Magic Boats is not liable for failure to perform obligations due to events beyond our reasonable control, including but not limited to: adverse weather, sea conditions, natural disasters, government regulations, travel restrictions, strikes, terrorism, or pandemics.

11. Environmental Policy

We operate within Giftun Island National Park, a protected marine reserve. Guests must follow all environmental regulations, including:

• Using only reef-safe sunscreen
• Not littering — all waste must be taken back to shore
• Not feeding or touching marine life
• Not collecting shells, sand, or coral
• Following designated swimming and snorkeling areas

12. Photography & Media

We may take photographs or videos during tours for promotional purposes. If you do not wish to be photographed, please inform us before the tour. By booking, you grant Red Sea Magic Boats permission to use such media for marketing unless you opt out in writing.

13. Governing Law

These terms are governed by the laws of the Arab Republic of Egypt. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hurghada, Egypt.
